UPDATED: 'Sister Wives’ lawsuit coming back to Utah courtroom




The lawsuit filed by the polygamous Brown family goes back to a courtroom on Thursday. But the plaintiffs, made famous by the television show "Sister Wives," can already claim some successes.
The Browns have won the issue of whether they are allowed to sue, and they managed to win it without getting prosecuted for bigamy. That means U.S. District Judge Clark Waddoups will hear arguments Thursday on the heart of the case: whether Utah’s statute making plural marriage a crime is unconstitutional.

    We don't want to be in jail, nor to we want the govt to make our fake marriages legal. How can we get food stamps for all the spirit babies then, or free govt insurance?

    1. I agree, they want the Goverment to not investigate them, leave them alone to have multipal marriages so they can keep defrauding the system. If the Government made all the marriages legal then Kody would have to support all seventeen children on his own. They can't have their cake and eat it too,they either want plural marriages legal and they support themselves or not legal and still support themselves....either way the Government needs to crack down on all the fraud.

      The glutting of the system by those using the "Principle" will go on as usual.

      It seems likely that the Browns, probably with the encouragement ($$?) of silent, like-minded groups, agreed to parlay their SW notoriety and be the poster-family for this filing and case. F-8 and TLC had to have been onboard with it too since it was a win-win for them to keep interest going in the show.

      Kody must be just loving the extra print and chatter about himself.

It is wild that everyone want to cruse this family, It not the governments job to say who are how many women you can have, I think the Browns stand up for there beliefs and I have more respect because Cody because he loves everyone of his wife and girlfriends, and he takes time with his children unlike many other men who go out and has 5 or 6 kids and never pays out one dime and here is where the taxpayer and the government has to step in and give them free health care, free house, free food, tax credits for having more children and not work,,,,, so if you notice people like the browns and the Dugers family take care of there own children and there own bills,,, They don't sit around wait for the first of the month and get there government checks, and there food stamp card to be credited up to $700 for food, so chill people, this show is no different then the other shows and if one show are to be paid !!!

    3. The Browns are Fundamentalist Mormon, LDS doesn't consider them Mormon, but they changed their religion from the original, not Kody's family. As an outsider studying their religion, they actually are practicing the true Mormon religion. Many splinters appear in all religious sects, but don't feel you can count them out as Mormons.

    4. They most certainly are Mormon. Id argue they are true Mormons. The LDS church changed its policy so UT could gain statehood. They now say plural marriage is okay in the afterlife only. What would a true follower do? Listen to Joseph Smith, right? Of course! Either way, the Mormon churches all contridict the bible. When I realized that, I left their church.

    1. Hi Anonymous @ 12:27: I think that the Browns are fighting for both. Most cases of this nature argue a specific plaintiff's issue, and then argue a larger issue. An example of this would be the abortion case, Roe vs. Wade. The woman who went by Jane Roe, an alias, was attempting to fight for her own personal access to an abortion, and ultimately, when the case landed at the US Supreme Court, the issue of legalization of abortion for all women was argued. Ironically, by then, Jane Roe had given birth, so her own personal case was moot.

    2. Wow. I had never thought enough about roe vs wade to know that she gave birth. I wonder how that child felt about her mom seeking an abortion. I think it will be interesting to see how the courts rule about people calling themseves married when they are not or even eligible to be married. Because if I get what this case boils down to is being able to claim a marriage that is not or never will be legal. It doesn't sound like they are trying to make ppolygamy legal just trying to tell Utah that if people want to pretend to be married they have to let them. It seems like utah is already letting them do that. What am I missing

    2. I agree... it didn't play out the way they wanted it to play out. Maybe a high-profile arrest with a giant media frenzy followed by a multi-million dollar lawsuit against the state for persecution, or whatever? Instead they're forced to follow up with yet another
      scheme out of Lameville. What's even worse is how insulting it is that they think they're so much smarter than the world.

      How about paying back some of the money the taxpayers have spent to support you, instead of buying too expensive houses and cars, Browns?

    I have no problem with these 4 adults 'doing weird' or whatever gets them off. Who cares what they do or how they do it?

    I DO have a problem once they start having kid after kid after kid they can't and won't pay for and refuse to take responsibility for (Kody, this is about you), and that they have no way to emotionally support. This is WRONG and has far-reaching and long lasting effects.

    This 'family' is a joke, they don't even take their own lawsuit seriously. They're horrible.

In many civil lawsuits, the actual parties (plaintiffs and defendants) are not present for all the preliminary motions, legal wrangling, etc. This particular upcoming argument seems to be getting to the meat of the matter, so I can see some/all of the Browns showing up to put a "face" to the lawsuit.

    2. Hi Anonymouse: I do think it matters to society when a man collects wives. I believe that when you make a decision to do something, whether it's throwing litter out of your car window or burning tires in your backyard, you should ask, "What if everyone did what I'm doing right now? What would the world be like?"

      Statistics show that married men have better physical and mental health, financial stability, and community involvement. So, enter the likes of Kody Brown or Joe Darger. Each additional woman they marry takes a woman out of the marriage pool for a man. So, what would happen if this practice became widespread? Society would go in the toilet quickly if you had only 10% of adult men married to a lot of wives, and the other 90% of men unable to marry because there are no women left. Also, when you also consider what we've seen of the plygs regarding welfare fraud, tax evasion and bankruptcy abuse, it becomes obvious why we don't want this to become a common or even semi-common practice.

I don't care how many wives he has, I do care when he is never around to care for or financiaaly support all these kids. I don't care who you are how can anyone realistically say they can have quality time with seventeen kids. If you don't see your kids in more than a week because you're running between wives then HELLO there is a problem. If we asked these kids what does your dad do with each of you that makes you feel special or loved, what would that answer be. If we asked Kody what traits or special thing do you see in each of your kids.....Hmmmmmm bet he can't answer that one.

Why is it when women in other nations are fighting for polygamy to be made illegal, some in the US want to sanction it?

      I aree with you, I really do. What I don't care about is their sexuality. If you want to have 2,3,7,35 partners at a time - who cares as long as everyone is a consenting adult. The law shouldn't be there to regulate that kind of thing.

      I absolutely care about what happens when a child comes into the picture. Adults have to realize that the CHILD and the CHILD'S WELFARE must come first, putting their own wants, needs and desires at the bottom of the pile. When selfish adults, such as the Browns and other polygamous groups, disregard their children's futures for their own pleasure and desires, society suffers. In order to make their 'lifestyle' work, the women and children remain ignorant to the world around them and totally dependent on the man. This takes away the choices, options, and freedoms from the women and children, and because of this, society suffers.

      Basically: no kids = adults do whatever they want.
      One kid or more = adults be responsible and get with the program; get a job, support your kids, stop being selfish and encourage your kids to develop into the best adults they can be.

      I'm not saying that once a kid shows up, the adult stops living or having any dreams or goals, I'm just saying that if you choose to have a child, your child must come first, and you have to stop living for yourself. The Browns and Sullivan don't care about society, current or future. They only care about themselves.

    6. Hi Anonymouse: What I tend to find disturbing about "polygamy" is, the overwhelming majority of the time, it's actually polygyny: one man and multiple women. There are very few polyandrous societies globally. If things were equal and women were just as likely as men to have multiple partners, I wouldn't be as hesitant about the whole thing Indeed, one could argue that polyandry is actually more practical in an overpopulated world, since a "one woman/multiple men" scenario will not produce 120+ children as you see Winston Blackmore and other Mormon men of his ilk create with their plethora of wives. One woman cannot bear 120 children.

    7. Magic undies makes an excellent point. All we need to do is look at what has happened in China, where girls are culturally devalued, and the one child per family quota imposed there over 30 years ago. There have been the usual almost equal numbers of male versus female children recorded as born, yet as of 2005, the number of males under the age of 20 exceeded females by more than 32 MILLION. That's because millions of baby girl fetuses were aborted, as parents want to try again for a more desirable boy for their one baby. How does this relate to the practice of polygamy? Too few females to go around for too many males has caused unruly male populations and other social fallout. What if everyone did what the Browns and Dargers are doing? The numbers of "lost boys" would just grow and grow.

    11. Polyandry can never be equal to polygyny unless human biology becomes equally reversed as well. To have it truly match polygyny - the female needs to never be able to be pregnant and go through childbirth but all her husbands do. Again and again. Otherwise, how is it the same thing just cause the woman has a bunch of husbands? It's not at all.

      Anytime I've seen polyandry actually work - it's never involved the woman having any children and her harem of men were allowed to go elsewhere sexually in addition to her exclusively and/or bring another woman into the polyandrous marriage or relationship. Again - very different from your religiously mandated polygyny.

    12. Hi Anonymous @ 7:23: The fact that a woman has limited reproductive capacity is a societal and environmental advantage of polyandry over polygyny. You simply won't read about a problem with 100+ kids in a polyandrous family needing welfare support, because one woman cannot bear that many children. You do see that problem in Mormon polygyny. In a polyandrous family, you have only one child being born every nine months or so, barring multiple births.

      This is all academic, of course, because men are unlikely to put up with polyandry, and women are unlikely to desire it.

Something that men can't possibly fully relate to having never been there/done that nor w/any anxious prospect of doing so.

      and yes, i agree it's all academic because men ARE most unlikely to put up with polyandry even without personally childbearing involved. and that in itself gives a lot of food for thought.

  8. I don't know if it should be legalized or not, but definitely they could come after the men involved to take care of their kids financially and not depend on the state to do it.
    If it is ever legalized I would hate to be a wife involved in a plural marriage if one of the other wives decided to divorce and get out. There goes 1/3, 1/4, 1/8 of whatever you have when she leaves!

  11. Regular old poor families with lots of kids still get a lot of state money. If the family situation was legally recognized, and they, as a group have five adults and 17 kids, then they have just over three kids per adult.

    Three kids per adult is kind of like a regular family with two parents and 6 kids.

    If the regular family with 2 parents and 6 kids have a child five or under as part of their family, they can earn up to: $71,947/year 5,996/month in the state of Oregon and still get their WIC checks.

    So for this family, that would essentially be 2 families of 8 plus one singe parent family of about 4, the maximum they could earn in a year and still receive government food assistance would be $186,000.

    Almost $200,000 in income and still qualified for assistance, if their family status was legal and they lived in Oregon, based on Oregon's current income levels.

    As it is...if Kody lived in Oregon, claimed he and Meri were raising all of his kids, and the other women happened to live in the house, their income could be $181,847 today, without any laws changing, and they would still receive assistance, based on a family of 8 plus the additional 15 people in their family at about $7000 each.

    It's almost like the beast was designed to be bled, don't you think? They don't even have to lie or cheat to get the money.

    The issue is almost less, "How many people can be married to each other?" than "How many kids can one family be allowed to have?" And I don't know...but that seems like a dangerous question to let the government answer...

    Either way, when I had two kids under five and was on wic, the check was bigger than I could actually spend. We had a list of foods we were allowed to buy with it, milk cheese, nuts, fresh produce (even from the farmers market) and cereals. But try as I might, buying everything on the list, I still didn't spend as much money as they gave me to spend. Pity I couldn't have kept the change...I'd have invested it in a college fund. ; P

Low-income families who meet a variety of requirements--such as income per family member, employment status and citizenship--are eligible for food stamps, regardless of sex, age or marital status. This is different from the WIC program, which is geared toward the nutrition of women, infants and children. Often used by women who are pregnant or have small children, WIC provides certain items off a small list of products to meet the needs of pregnant women and babies. Food stamps have a broader product range than WIC.

Wic is diferent because it requires the recepient to take nutritian classes breastfeeding classes and requires the children be weighed tested for anemia and focuses on the fetus, infants, and toddlers getting the proper nutrients for optimal growth at the most critical time. I would rather pay for this than have under developed children to try and educate later.

    1. I suspect this lawsuit against the state of Utah may be a reason that the Browns remain in Nevada. I would not want to live in a state that I'm suing, especially if that state is aware that I'm doing something illegal. I'd essentially be a sitting duck. I believe that the Browns are involved in a number of scams that haven't come to light yet, but the state of Utah may be aware of them.

  15. If I understand it correctly, the lawsuit is not about making plural marriage legal per say... it's just about changing the law so that it's not ILlegal to practice plural marriage. They aren't wanting the state of Utah to legally recognize Janelle's, Christine's and Robyn's "marriages" - they just don't want it to be a crime. That way they aren't breaking the law by living the way they do.

    1. They certainly made a HUGE deal of the get away on the show, but then bloopered it when they said on a show no, they didn't run, they wanted out for other reasons. I saw the clip on the blog here somewhere. REALLY made them out to look as hypocrites, and a potential problem for their case.

    2. That's right, they said we have to go because there was police driving by their house and they were being investigated. So now that it's in the courtroom are they just brushing it off? You would think they would be more involved if they wanted to have their lifestyle legalized. I guess now that they are living the high life in Vegas they just can't be bothered anymore. Once TLC has no more use for them and they are cancelled they won't be able to get state help because they said publically Kody is the father of all seventeen kids. I see a big wake up call in the near future and some REAL TEARS from Meri and Robyn.

Because - I bet if they make a big fat hairy deal about the police drivebys in Lehi and the records are pulled (which is what I would do if I were the state) the record will show that the police were called BY THE BROWNS to get rid of the papps that were hanging out in front of their house trying to get candid shots of the fam.   21. According to Honey Boo Boo's mom, they get $18K an episode, of which she has accounts set up for the kids that they can't touch except for college until they are 21. She doesn't even see the checks, TLC makes the deposits and sends her the statement.
    Wonder what type of accounts the Browns set up for their kids?

    1. Yes from what I read, Kate Gosselin said she had set up trust funds for her kids - but it came out during the divorce that she was fibbing. I'm just saying.

      And the articles I read don't quote mama June as giving the amounts - the articles are basically guessing the amounts.

    2. The Gosselin kids did have a trust set up.
      Around the time TLC sued Jon Gosselin and Kate & Jon divorced, a PA Dept of Labor letter was posted online which noted that a trust was to be set up for the kids. Kate did it, BUT it was done just before the letter was released (kinda fishy timing, IMO). What is sad about the trust is that the funds can be used for the education, medical needs, and "care" of the kids. In other words, Kate can be using the money the kids earned to pay for private school tuition, nannies, babysitters, vacations,, etc, etc. By the time the kids reach the age of maturity, it could be all gone.

But from what I read - and I might be wrong on this since I don't follow the Gosselin saga - Kate had said that this had been done already...well prior to the divorce. and clearly since she can go in and "dip" prior to them coming of age, well it's not really a trust fund in the sense I think of a trust fund as being - savings for higher education or to be given to a child after the come of a certain age. Also from what I read (Not sure if this is a reliable source) there is maybe $10k for each child in the trust. Not even enough to pay for a semester or two of higher education.

      I'm sure Mama June has followed the Gosselins and other families, and knows just what to say to get the favor of the fans. the term "trust fund" is so generic, because there are so many different types of trust funds, the irrevocable type and then the kind like what Kate G set up, where she can dip into the funds as much as she likes. also IMO, from what I've seen of HBB (can't watch much as the type of humor in the show turns my stomach) there is no amount of money to compensate for the damage she is doing to her kids, making them laughingstocks, not teaching them manners...etc...Manners IMO are vital in order to make it in the world. Whatever trust funds the HBB children end up with, it is NOT going to be enough to set them up for life, maybe enough to get them through some higher education, although at this stage I would be amazed if they graduate from high school.

  22. The madcap exodus from Lehi to Las Vegas was pure *fake drama TV.*
    That was a turning point for many viewers...watching the ridiculous, *staged frenzy* of stuffing the vans and cars in mock panic-mode as if the Feds were already bearing down on them to handcuff Kody before they "got out of Dodge"....THAT was the telling moment of what these people were all about !!!

    Keep in mind there were **16** children, from teenagers down to a very young toddler, who had be to dragged through such an unbelievable farce.
    Who would do that to their children !!!???

    Oh yeah, the adults all played up their mock horror very well...and yes, including Janelle !!
    They all played it up as they told all those children, with supposedly 3 days notice, they all had to flee so that Daddy Dearest wouldn't be arrested.
    What kind of *parents* would mess with children's minds like that ???
    And...if it were even remotely true, what parent would want their children to be filmed while hearing such frightening news?
    Again, who would do such a thing to their kids??
    Obviously, parents who more interested in ratings and $$$$$ !!

    And then later, once they are all cozy in their not-shabby-at all, separate rental houses, there is a TV couch chat where it is revealed that "Kody always wanted to move to LV and we came here for other reasons too"....while all of them nod with a sh*t-eating grin on their faces....and yes, including Janelle.

    Easy to see now that once the TLC money was reliably coming in, and once Sobbin was wife # 4 and there really was no room for her in their Utah plyg habatrail house...and with TLC really wanting some blockbuster scenarios to the show keep it going....
    Kody and his harem thought, "Hey, with all this money coming in why are we living in this dump....lets' go to Vegas where KodyKing wants to go..and we all can get our own houses."

    No doubt between the plyg groups they were connected to cheering them on, and F8/TLC wanting new and more drama...the idea for the faux-forced move AND the lawsuit was created.

      This is spot-on. Worse even than Drake the dog being put down on tv was the crying faces of the children when their "dad" told them that they had to pack and leave in three days. Barely enough time to throw your possesions in a suitcase, much less time to say goodbye to friends. That was just such an awful thing to do and then to televise it to make a buck is sick behavior and shows ZERO consideration for the feelings of those kids. THEN to admit that it was in Kodester's plans all along...makes me furious on behalf of the kids.

    My opinion of how many sex partners someone has is for when there are no children involved. I don't care what consenting adults do with other consenting adults. Have multiple partners, polyandry, polyfidelity, polywollydoole, polyeverything. When you decide you want kids - everything changes.

Lisa, I know that the "secrecy breeds abuse" argument is used to support legalization, but in my experience many polygamists live apart from mainstream because they think that they can stay pure and righteous that way (uncontaminated by the wicked "world"), not because they are afraid of being prosecuted. Legalization won't change that mindset. In addition, three of the worst sexual abusers that I became aware of in the polygamist group I belonged to, all lived in suburbia. As to the welfare useage, polygamists can use welfare legally and as long as men keep having huge families they can't support, they will keep on using welfare whether polygamy is legal or not.

  35. For those of you that are curious about Mykelti's leaving traditional HS to attend College HS, I live in Las Vegas and have a daughter in HS. Yesterday I received a brochure in the mail for College of Southern Nevada High School.

    A few interesting tidbits in the brochure:

    "College of Southern Nevada High School is a unique opportunity for those in the 11th & 12th grade to complete high school while attending college for free, with a support system to help them achieve their goals."

    -Free tuition for 12 college credits each fall and spring semester students attend CSNHS

    -Full-time high school teachers for core high school courses and proficiency tutoring

    What are the requirements?
    -GPA
    -Level of courses completed
    -Test scores
    -Current teacher recommendations
    -Dean's recommendation
    -Student essays
    -Attendance/behavior records

    I don't think my daughter is interested in attending, but it sounds like a great opportunity for kids whose parents can't afford college and a way for the kid to fast-track their way into a university.

  36. I have mixed feelings about the lawsuit. On the one hand, I don't approve of a man having multiple "wives" (or sex partners), and I don't approve of anyone having a child they can't afford. On the other hand, these things happen even without polygamy. They are not asking for legal recognition of a polygamous marriage; they are asking that it not be illegal for a man to live with multiple partners.

    If government aid wasn't involved, this would be a no-brainer; how can we tell people how to live? (Especially since the children ARE well cared for; I don't think anyone can allege child neglect.) But I don't like the idea of people procreating without being able to afford the consequences... that's what really annoys me.

    The fact that the law is rarely enforced is an additional wrinkle. It will be interesting to see what the court decides.

      I see your point but the idea that they are not wanting to make the marriages legal offends me because of the following: 1) If Kody dies, only one wife has legal entitlement to any of his insurances; 2) When the women are retirement age, which of the four will draw on Kody's social security; 3) because the marriages aren't legal, Kody isn't legally responsibile for the children as evidenced by his lack of financial support to his illigitamate children.
      What this all boils down to is if the marriages are not legal, then the concubines and the children of the Kody and his concubines are left to become wards of the state at one or more times in their lives and I don't know about you but I am opposed to our government allowing this to go on. Also, he says they are married so man up and treat those women as your wives and pay for their households and not just Mari's. The example he sets for his children is not good and so what other people do this--but other people are not on TV trying to tell us how great their lives are.

    2. Kody is responsible for his kids, regardless of the relationships with their moms. He hasn't given up custody, therefore he is responsible for them until they are 18, and maybe older if they are in college. As far as retirement goes, only Meri can collect on his SS.

      if he were responsible for his kids, why were so many of those kids' moms collecting welfare, foodstamps, and childcare assistance on them? Also, if the other three wives are "married" to him, why shouldn't they be allowed to collect his SS? So the push for the Browns to have their marriages allowed but not made legal brings into my mind a question of why not make them legal. Why go through the expense of a lawsuit if your thing is just leave us alone. From all I could see, no one was botherering them unless they were going to get in trouble for welfare fraud.

    5. What I meant is that he is legally responsible for his kids. I doubt that now that they have come out to the world, that the wives could claim that they don't know who the father is. And 3 of the marriages are spiritual marriages, which are not recognized by the government, only Meri's is, she is the only wife that can collect his SS. There is a way to get around this though, if Kody had divorced Meri after 10 years and then married either Janelle or Christine, stayed married another 10 years and then married the other, they all could collect his SS.

    2. I think there's a huge difference between polygamy and gay marriage, which puts equal power into the hands of both partners. Polygamy undermines the equality of women. In polygamy only the man can take another partner. Only he can divorce any woman in the marriage, while the women can only divorce him and have no real say about the new partners he wants to introduce to the mix. There is the inherent instability of a plural arrangement. Gay marriage is much more akin to monogamy - two committed partners - with no set-up for one of them to have sole rights to introduce another partner at any moment. Children thrive on stability, and if daddy can bring a new woman home when he feels like it, then children lose that stability - not to mention the time that is needed to establish secure relationships with both parents. Polygamy spreads all resources very thin - emotional and financial. Daddy being on the lookout for new wives distracts from taking care of the wife and children he already has.

  42. Decriminalization means no one can be prosecuted for polygamy (Pointless in Utah anyway since it has a policy of non-prosecution). Legalization means that a polygamist can marry any number of women he want to and have legal marriages with them all. The Browns know that the first is much easier to get passed, and that it is the first step towards legalization. The Dargers are openly pro legalization.

    However, it is plain to see FOR NOW they want decriminalization, next step, legalization. Many a polygamist will disagree on the legalization, only the real men in my book will want to take on that responsibility. At least Joe Darger wants all his marriages recognized, and would accept that responsibility. How on earth could the FLDS handle that? They change those poor women and children around like something I have never seen.

      The whole First Wife power would diminish, since the first wife really has no more standing than any of the others.

      Responsibility for all the children would fall to the father...legally.

    Seems the sisterwives have a not so happy customer. As she puts it "Am patiently waiting for the ring I ordered or an email or something. You got my money where's my ring?"

    Being that Meri and Kody were spotted at Disneyland a couple of days ago, somebody has dropped the ball. But not very surprising...makes you wonder how many other customers are like this lady who have ordered from MSWC, been billed, and still haven't received it. Let's hope this customer contacts her credit card company immediately to get her money back!

    So far no answer from a sisterwife or MSWC representative.

      Apparently Mr Turley must have missed watching the episode when Kody and Meri traveled back to Lehi to take care of poor Drake. Or when Kody and families went on their road trip to Carthage and made a stop at the pawnshop in Utah. Or any of the other numerous times Kody has ventured back into Utah.

      Let's hope the judge will notice what we have - that Kody didn't look concerned about a risk of prosecution at all on film. Maybe Kody's afraid Utah will arrest him on the grounds of having a bad haircut...

      I would like to see in a few days a more in depth report here, stating which side each important character is really on, Seems the judge just doesn't get it.
      IF polygamy were to be decriminalized, should it not have many safe holds in place as far as education, welfare, etc.... (child marriages) and the difference shown between a few baby moms and thinking your life depends on your husband calling your name? This needs a bit sorting out. Even Baby Moms have a responsibility to give their child a decent education, and so on.
      Seems this will really go no where.

  47. I know this is OT, but I thought it was interesting but not surprising, that yesterday when the Brown's lawsuit's opening arguments were heard that no Browns attended, but 2 of the Darger wives were there!

    Par for the course for the Browns to start something and not follow through. The Dargers, impressed me as people who don't just talk the talk. but also walk it and sure enough - they're the ones who gave interviews and appeared in court yesterday.

    BUT it does pertain to many underage child brides forced in marriage, which the law chooses to do nothing about now... almost a child slavery. Bring them up uneducated, socially stunted, and marry them off and have them pregnant... how hard would that be to climb out of?

  49. I just want to clarify something regarding judicial review for the folks worried about the judge being bias and pro-Browns. Court cases involving alleged violation of rights, especially rights guaranteed by the bill of rights, will receive a stricter standard of review. The precedent established by the Supreme Court indicates that cases involving marriage, pro-creation, religion, and free speech (to name a few) will receive the highest level of judicial review. Therefore, the STATE (not the plaintiff) must prove that it has compelling interest to violate/impede upon a person's rights. AKA the government better have a damned good reason for violating a person's rights. In cases that do not merit stricter scrutiny, the victim/plaintiff/attorney/etc must prove that the government has wronged or violated his/her rights in a certain way.

    Now...states do not have to follow the same standard of review as the Supreme Court, but most do. I think what we are actually seeing in the Brown's case is Judge Waddoups adhering to the strict scrutiny precedent, and thus challenging the state to prove that there is still a compelling and necessary reason to keep polygamy decriminalized. Personally, regardless of whether or not I think someone's lifestyle or the case at hand is copacetic, I want judges approaching cases and the state with a degree of skepticism when a persons constitutional rights are involved.

  50. Okay, I have to comment on the Disney obsession. Does anyone know who, or if anyone accompanied Kodpiece & MMQC to Disney? Were there children along? You know, since it's targeted as a place for kids. I do not get the Browns obsession with Disney. It's only the Happiest Place On Earth if you have money to burn. I'm beginning to believe they have a combined IQ that equates to tepid bath water.

    Shouldn't Meri and the other Merry Band Of Browns be organizing their mansions? I would think Meri would need to get that wet bar stocked and ready for upcoming entertainment season.

The most expensive regular priced apron on the SLT website is $49.95. I'd be willing to bet that the SW aprons will be very pricey. with the dog paw. and a 5 week delivery window.

  52. For me Turley lost all credibility when he stated the lost boys was a "myth". So many boys were on different talk shows including 1 was on sister wives. How can anyone believe or respect him?

    4. Wow, the lost boys are a myth? Ignoring the plethora of available documentation that they do exist, how does Turley explain the simple mathematics of a polygamous Mormon community? How can one man have five wives without there being four men who do not have wives? Unless, I suppose, we're to assume that four bachelors do go without wives, and neither the community nor the bachelors themselves see this as problematic. Another possibility is that polygamous Mormons have a high number of female births, which would be a scientific phenomena worthy of study.

      I'm sure this issue will slowly be winding it's way to the Supreme Court anyway, (and I'm not a lawyer) but I guess I'm not understanding why this judge doesn't just rule against the Browns, let them appeal, and then let the land's highest court deal with it.

      I don't see how the Brown and Dargar women can all 'legally' call themselves wives without the marriage licenses, and I'm not certain why the judge/attorney general would refer to them as such. That kind of bothers me, a lot. If I were in a courtroom, I couldn't just start calling myself someone's wife without a marriage certificate or appointing myself a lawyer without a law degree...why do the Browns get a pass?

      Really, I feel ill just reading about the direction this lawsuit is taking.

  54. Long time lurker, first time poster. I totally love this blog! I was so surprised when the ticker on my local tv news channel actually mentioned this case. In Toronto, Canada :O Have never heard of a fundy mormon plyg issue here.There is Bountiful in BC, but nothing I've heard of in Ontario. If we have plural marriages they tend to be associated with newcomers to Canada. Just shows how much awareness the Sister Wives show has created.

She even stated Christine and Janelle are done having children. For myself I would not want to be in s Purl marriage...After watching the show I want to wish the Brown family all the happiness in their life style and all the best. Even with all their issues with such a large family that their seems to be a lot of good qualities in their family that even single families never find in their life time.
